El principio de oportunidad en el nuevo sistema penal acusatorio

Abstract

El Principio de Oportunidad en el nuevo sistema penal colombiano, se erige como la única excepción a la obligación que tiene la Fiscalía General de la Nación de adelantar el ejercicio de la acción penal y realizar la investigación de los hechos que revistan las características de un delito. Su nacimiento, además de estar aparejado con un sistema penal acusatorio, tiene diferentes clases de fundamentos, de entre los cuales se puede destacar la problemática del alto índice de delincuencia y la incapacidad del órgano investigativo y de la Rama Judicial en general, para investigar y juzgar la totalidad de conductas señaladas como posibles infracciones al derecho penal.

Abstract: The principle of opportunity in the new penal system is the only exception to the obligation that the General District Attorney of the Nation’s office has of advancing punitive action and carrying out the investigation of the facts that probe the characteristics of a crime. Its birth, in addition to having been prepared by a penal accu- satory system, also has different classes of foundations, among which it is possible to emphasize the problem of the high rate of delinquency and the incapacity of the investigative sector and of the Judicial Branch in general, to investigate and judge the totality of conducts indicated as possible infractions to penal law.
